On 2 October airBaltic filed the proposed final order for its DIP financing, a redline against the interim order Judge Beckerman entered on 16 September, and the form of the DIP credit agreement. The court will consider final approval at a hearing on 9 October.
The facility is still up to €350m in three tranches. Tranche 1 is €175m: €140m is already available under the interim order and the other €35m comes after the final order is entered. Tranche 2 (up to €125m) and Tranche 3 (up to €50m) also need case milestones to be met and a separate priming order on top of the final order.
Strategic Value Partners is DIP arranger and Barclays Bank Ireland the fronting lender, with GLAS as administrative and collateral agent. The filing says the proposed order is still being negotiated with the DIP lenders, the official creditors’ committee appointed on 25 September (lead counsel Willkie Farr & Gallagher) and other parties.
It is not settled yet. At least eight objections or reservations of rights to entry of the final DIP order were filed on the docket between 23 and 30 September.
